Ontario's New Foreign Buyer Tax & Rental Control

( Official Press Release )

Today, Premier of Ontario Kathleen Wynne introduced Ontario's Fair Housing Plan (16 measures) to "help more people find affordable homes, increase supply, protect buyers and renters and bring stability to the real estate market. "

The TWO most significant measures are:-

* Non-Resident Speculation Tax (NRST) of 15% for foreign buyers of residential properties in Greater Golden Horseshoe.  This is similar to British Columbia's Foreign Buyer Tax on Metro Vancouver real estate.

*Almost all Ontario rentals will be capped at 2.5% per annum.

  • 對外國買家徵收15% [非居民投機];

BNN have a short summary of the 16 measures:-
  • A 15-per-cent non-resident speculation tax to be imposed on buyers in the Greater Golden Horseshoe area who are not citizens, permanent residents or Canadian corporations.
  • Expanded rent control that will apply to all private rental units in Ontario, including those built after 1991, which are currently excluded.
  • Updates to the Residential Tenancies Act to include a standard lease agreement, tighter provisions for "landlord's own use" evictions, and technical changes to the Landlord-Tenant Board meant to make the process fairer, as well as other changes.
  • A program to leverage the value of surplus provincial land assets across the province to develop a mix of market-price housing and affordable housing.
  • Legislation that would allow Toronto and possibly other municipalities to introduce a vacant homes property tax in an effort to encourage property owners to sell unoccupied units or rent them out.
  • A plan to ensure property tax for new apartment buildings is charged at a similar rate as other residential properties.
  • A five-year, $125-million program aimed at encouraging the construction of new rental apartment buildings by rebating a portion of development charges.
  • More flexibility for municipalities when it comes to using property tax tools to encourage development.
  • The creation of a new Housing Supply Team with dedicated provincial employees to identify barriers to specific housing development projects and work with developers and municipalities to find solutions.
  • An effort to understand and tackle practices that may be contributing to tax avoidance and excessive speculation in the housing market.
  • A review of the rules real estate agents are required to follow to ensure that consumers are fairly represented in real estate transactions.
  • The launch of a housing advisory group which will meet quarterly to provide the government with ongoing advice about the state of the housing market and discuss the impact of the measures and any additional steps that are needed
  • Education for consumers on their rights, particularly on the issue of one real estate professional representing more than one party in a real estate transaction.
  • A partnership with the Canada Revenue Agency to explore more comprehensive reporting requirements so that correct federal and provincial taxes, including income and sales taxes, are paid on purchases and sales of real estate in Ontario.
  • Set timelines for elevator repairs to be established in consultation with the sector and the Technical Standards & Safety Authority.
  • Provisions that would require municipalities to consider the appropriate range of unit sizes in higher density residential buildings to accommodate a diverse range of household sizes and incomes, among other things.

Foreign Home Buyers Tax Surcharge in ON?

In August 2016, British Columbia (BC) implemented 15% Foreign Buyer Surcharge for their real estate purchases.  Subsequently, there have been discussions and debates whether a similar levy is to be implemented in Ontario. 

Toronto Real Estate Board (TREB) "cautions against the imposition of provincial foreign buyer tax surcharge." TREB's survey last Autumn indicated, "only an estimated 4.9 per cent of GTA transactions, in which TREB REALTOR® Members acted on behalf of a buyer, involved a foreign purchaser. The vast majority (80 per cent) of foreign buyers purchased a home as a residence, a home for another family member to live in, or as an investment to rent out to a tenant."

TREB suggests the provincial government to explore policy changes that are not only demand-focussed but also supply-focussed.

"The provincial government should work with municipalities and related industry stakeholders to look at ways in which the supply of housing could be increased, including, potentially revisiting land use designations in built-up areas to allow for a broader array of home types to be built, streamlining the development approvals process, streamlining the permit process, and examining ways to incentivize land owners to develop," TREB President Mr. Cerqua.

自從BC省在去年八月實施向購買BC地產的外國買家 額外徵收15% 稅項, 安省亦有不少探討和辯論實行類似政策。

上周五, 多倫多地產商會 (TREB) 發放新聞稿, 對徵收省外國買家附加稅措施有相當保留。  據 TREB 在 2016秋季調查, 去年透過其會員的交易中, 只有4.9%買賣牽涉海外買家, 大部份 (八成) 用作個人府邸、供家人居住或投資為出租物業

TREB 建議省政府政策不要單單着眼於[需求], 應該在[供應]方面作出長期策略。

TREB 總裁 Cerqua 先生: "省政府應該與市政府和業界研究不同增加房屋供應的方案: 例如, 改變現有用地規劃、簡化地產發展計劃審批過程、加速發放批准文件工序, 或獎勵地主發展。"

GTA Home Average Selling Price (1966 - 2016)

We know that Greater Toronto Area (GTA) home re-sale market has been preforming strongly and made record resales both in 2015 and 2016.  In fact, the GTA home value (measured by annual average selling price) has been steadily appreciating since TREB tracking started 50 years ago in 1966.

The average selling price of a GTA in 1966 was $ 21,360.  In 2016, the price was $ 729,922, 34 times of 1966's.  This represents an average value appreciation of 7.32% every year for the past 50 years.  As shown, GTA property has been a very reliable longer-term investment vehicle to accumulate and grow wealth.

早前已報告 #大多倫多 住宅重售市場分別在2015和2016年創出新銷售紀錄。 其實, 自 #多倫多地產商會 從1966開始記錄市場數據 至今50年, 大多 #地產物業 價值一直穩步增長。

在1966年, 一間大多樓房平均售價是 $2萬1; 2016年的平均價脹34倍為 $73萬。 換句話說, 這50年來, 大多房產價值平均每年上升 7.32%。 所以, 大多倫多地產 不愧為一項穩健的長線儲蓄和投資工具。

Toronto Area Home Resale Market - December 2016

"Record Sales in 2016" was the headline of TREB Market Watch (Dec. 2016).  113,133 home re-sales in Greater Toronto Area in 2016 representing a 11.8% increase and also marking a second consecutive record year for home sale.  TREB President Larry Cerqua attributed the stellar market performance as follows.

"A relatively strong regional economy, low unemployment and very low borrowing costs kept the demand for ownership housing strong in GTA, as the region population continued to grow."

多倫多地產商會 12月 [市場動向] 報告標題為: "2016年創新銷售紀錄"。 全年大多倫多錄得 113,133 宗住宅重售, 較去年上升11.8%。 市場連續兩年創出新紀錄。 TREB 總裁 Cerqua 先生 解釋大多地產成績的主要原因:

"強健地區經濟、穩定就業率、 極低借貸成本、配合大多倫多人口持續增長, 促使大多置業意向和需求保持強勁。"

Key Year-Over-Year Comparisons (vs December 2015):-

* Sales increased 8.6% to 5,338 with average selling price at $730,472, 20% higher than last year $608,714

* Condo Apartment sub-market led the sales growth made up almost 1/3 of home sales

* Average selling price for Detached and Townhouse appreciated more than 23% in the past 12 months

* Active listing was low, nearly half (52%) of last year level.
